The recent Motion for a coherent legislation concerning “sans-papiers” calls for legislative measures to further specify the criteria that should be applied in hardship cases for undocumented migrants, who have lived in Switzerland for a long time and who have “integrated” themselves, especially families with children attending school. However, is integration the only factor that should be considered in such cases, particularly when children are concerned?

Natürlich können «Sans-Papiers» nicht abstimmen und haben schon gar keine Lobby in Bern. Deshalb war meine erste spontane Reaktion auf den Vorstoss «Für eine kohärente Gesetzgebung zu Sans-Papiers» der Kommission für soziale Sicherheit und Gesundheit des Nationalrats eine Frage: Geht es allenfalls darum, von den wichtigen anstehenden Herausforderungen der Sozialversicherungspolitik abzulenken?

Am 26. April 2017 entschied das Bundesgericht in einem Grundsatzentscheid zur Dublin-Haft: Die separate Inhaftierung von Mitgliedern einer afghanischen Familie sowie die Fremdplatzierung der betroffenen Kinder hat das in der Europäischen Menschenrechtskonvention (EMRK) garantierte Recht auf Familienleben verletzt. Die Inhaftierung des Ehepaares im Kanton Zug lässt sich zudem laut Bundesgericht nur «knapp» nicht als unmenschliche oder erniedrigende Behandlung gemäss EMRK qualifizieren.
